Understand Mercer County Releases

“Released” describes the end of one agency’s custody, but it does not always mean freedom from all custody. At the Mercer County Jail, a judge may order pretrial release, dismiss a case, credit time served, or authorize another community release. A fixed county sentence may end after lawful credit. Mercer Pretrial Release Has Changed

Illinois began statewide nonmonetary pretrial release on September 18, 2023. A court now decides release or detention under Article 110 of the Code of Criminal Procedure, with a presumption of release on the least restrictive conditions allowed by law and statutory procedures for detention. This is not the same event as completing a county sentence, leaving IDOC on mandatory supervised release, or being discharged after all state supervision.

The Mercer sheriff’s jail page still displays a $42 bonding fee and JailATM bail instructions. That older or limited-purpose page text should not be read as a promise that any person can pay cash and leave. The court order controls. Ask the clerk for the current order and ask jail staff what final release authority was recorded. A fee line, payment receipt, or web instruction cannot substitute for the release entry.

Nonmonetary pretrial release also does not end the criminal case. Conditions, hearings, and later court orders may remain. A docket can show legal authority before the jail completes its operational checks, which is why a same-day court entry and physical release time may differ.


Mercer County Release Record Fields

A Mercer County release record is not one fixed certificate. The relevant fact may sit in a jail register, booking record, release sheet, transport log, court order, or jail-management entry. A focused request should name the person, approximate booking period, and the exact existing fields sought. Request a booking photograph as a separate item because the sheriff may treat the image as its own record. A release entry does not decide guilt, erase the court case, or prove that all supervision ended. It records a custody event. The court record and any receiving agency record have distinct purposes.


Request Mercer County Release Records

The Mercer County Sheriff’s FOIA page is the direct route for records held by the sheriff. Illinois FOIA does not require use of a special form, but the request must be written. It may be sent to mcso@frontiernet.net, faxed to 309-582-5158, or mailed or delivered to the Office of Sheriff at 906 SW Third Street, Aledo, Illinois 61231. The county Document Center also lists a general request form.

  1. Identify the person with full name, date of birth if needed, and an approximate booking or release range.
  2. Ask for the existing booking and release entry, including the time, release type, authority, and receiving destination.
  3. Request the booking photograph separately if it is needed and retained.
  4. Choose electronic delivery and ask for an estimate before chargeable copying.
  5. If material is withheld, ask for the cited exemption and the available review route.

A noncommercial Illinois FOIA request ordinarily receives a response within five business days, subject to a permitted extension. A response may produce records, deny or partly deny them, seek clarification, give an extension notice, or direct the requester to an available record. The first 50 black-and-white letter or legal pages are free under the sheriff’s posted terms, with added pages listed at $0.15 each. Existing records may be requested; the sheriff need not create a new report or calculate a release date.

Important: Illinois FOIA section 2.15 sets a 72-hour deadline for furnishing specified arrest-report information. It does not create a rolling Mercer County 72-hour release feed.


Mercer Release Records and Courts

Mercer County sits in Illinois’s Fourteenth Judicial Circuit and uses Judici for its public case index. Search by case number when possible. A name search should be checked against filing dates, charges, and any identity details shown. Relevant entries can include a pretrial-release order, detention ruling, dismissal, sentence, custody credit, probation, mittimus, warrant, or discharge entry.

The legal order can come before physical release. Jail staff may still complete identity, warrant, property, transport, and receiving-agency checks. For that reason, the docket time and the sheriff’s release time may differ without either record being wrong. The Mercer County Circuit Clerk can provide a plain or certified copy when the index lacks enough detail. Sealing restricts public access to qualifying material. Expungement directs eligible records to be handled under a court order. Neither process should be treated as an automatic promise that every copied photo or outside reference will vanish. Juvenile, medical, victim, active-investigation, security, sealed, and expunged information may be withheld or redacted under the rules that apply to each record.

Begin with the event most likely to have occurred. Mercer’s sheriff site publishes facility information but no searchable custody list, booking feed, 24-hour release view, or 72-hour release view. A named-person search therefore starts with the court docket and a jail call, then moves to the system that may have received the person. Written records provide the most durable confirmation.

  1. Search the Mercer Judici docket for the order or disposition tied to the custody change.
  2. Call the jail at 309-582-5020 and ask whether the person is held now and, if not, whether the final event was release or transfer.
  3. File a focused sheriff FOIA request for the booking and release entry.
  4. If a state sentence is possible, search IDOC and read the full individual profile.
  5. Use Illinois VINE as a notice and corroboration channel, then confirm with the named agency.
  6. When federal or immigration custody is documented, check the correct federal system.

A current institution means state custody continues. A status of parole or mandatory supervised release means the person has left the prison building under supervision. Mercer County Probation and Court Services is separate from IDOC parole. County probation is proved first by the sentencing order and may be confirmed through the local court channel. Federal and Immigration Release Checks

Mercer County Jail houses some federal prisoners in transit or awaiting trial. Leaving the Aledo building may therefore be a handoff to the U.S. Marshals Service rather than a community release. The BOP Inmate Locator searches by federal register number or by name and demographics. A “Released” or “Not in BOP custody” result concerns BOP custody only. The federal court docket determines detention and supervised-release orders, while USMS has no comparable public historic locator.

When a Mercer record names an immigration transfer, use the ICE Online Detainee Locator System. Search by A-number and country of birth when available, or by the supported biographical fields. ODLS is a current-location tool with a limited released-person window, not a full release archive. No result cannot prove community release. Mercer County has no verified ICE detention facility or local ICE contract, so a particular transfer must not be turned into a general claim about the jail.

Aledo Jail Release History

The Mercer County Jail opened in 1989 with 30 beds. A later 72-bed addition brought rated capacity to 102, and IDOC material notes a 2011 renovation. These are facility facts, not current population or annual release totals. The sheriff also reports holding Cook County prisoners and federal prisoners in transit or awaiting trial. That mix is why “left the Mercer jail” is not a safe synonym for “went home.”

The jail’s 2024 inspection counted 39 people on one inspection date. That point-in-time figure is not a live count and must not be used as a measure of annual releases. Only an agency record for the named event can establish where a person went.


Mercer Release Account Balances

Illinois law allows specified deductions from a county jail account before release. At sentence completion, 730 ILCS 125/20 directs the sheriff to mail the remaining commissary balance to the person’s last known address after lawful deductions. This account process is separate from the sheriff’s posted bonding charge and separate from proof of the custody event. A requester should seek any property or account acknowledgment only when it is relevant to the release record.

The statute permits deductions tied to costs listed in law, then calls for the balance to go to the last known address after sentence completion. It does not set the release time, decide whether another hold exists, or establish that a transfer became a community release. Property and account records can support the timeline, but the release line remains the key custody record.


Mercer Release Changes Jail Visits

The Mercer County Jail information page states an unusual local rule. A person released from jail custody during the prior six months may not visit someone currently confined there. The restriction can affect contact with family or peers who remain inside, even when the former detainee returned to the community.

This six-month limit is a visiting rule. It does not show parole, probation, a new warrant, or continued custody. Those questions must be checked through the court, county probation, IDOC, or the agency that holds the relevant record. The jail page is the source for the visitor restriction, while release status still comes from the final custody entry.

Call the jail before planning a visit after release. Staff can apply the current visitor rules, while the written release record remains the source for the prior custody event.
